1. About These Terms

These terms and conditions govern your use of the Heights Cargo Limited website at heightscargo.com and the logistics services we provide, including sea freight, air cargo, customs clearance, warehousing, ground transport, and door-to-door delivery between the UK and Kenya and between China and Kenya.

By using this website, requesting a quotation, or instructing us to handle a shipment, you agree to these terms. If you do not agree, please do not use the site or our services.

Heights Cargo Limited is a Kenyan company with offices in Kenya, the United Kingdom, and China. References to "we", "us", and "our" mean Heights Cargo Limited. References to "you" mean any visitor, enquirer, customer, or shipper using the site or our services.

2. Website Use

You may use this website for lawful purposes connected with arranging shipments and learning about our services. You agree not to:

• Submit false, misleading, or fraudulent information in forms or calculator requests.
• Attempt to gain unauthorised access to any part of the site, our admin systems, or related infrastructure.
• Scrape, copy, or reuse site content in bulk without our written permission.
• Interfere with the site's operation, security, or the accounts of other users.

The content on this site, including rate information, guides, images, and branding, belongs to Heights Cargo Limited or its licensors. You may quote or share reasonable extracts with attribution; you may not republish substantial parts of it without permission.

3. Rate Calculator and Estimates

The rate calculator on this site gives instant, indicative estimates for sea and air freight. These estimates are subject to the following:

• Estimates only. Calculator output is not a quotation and not a fixed price. It is a planning figure based on the route, mode, weight, volume, and rate cards currently published in our system.
• Chargeable weight. Air and sea LCL freight are billed on chargeable weight or volume, that is, the greater of the actual weight and the volumetric equivalent. Your final charge depends on the actual cargo once measured and weighed at our warehouse.
• Excluded costs. Unless expressly stated, estimates exclude customs duty and taxes, port and terminal charges, storage, inspection fees, insurance, and last-mile delivery beyond the stated destination.
• Rate changes. Freight rates change with carriers, seasons, and fuel prices. The rates in force on the day of booking apply, and any earlier estimate lapses accordingly.
• Currency. Estimates are shown in the currency of the relevant rate card, either KES, GBP, or USD. Invoices are issued in the currency of the booking confirmation.

A binding price is only created by a written quotation from Heights Cargo or your booking confirmation.

4. Quotations and Bookings

• Written quotations are valid for the period stated on them, commonly 14 days, unless a shorter validity is noted.
• A booking exists when we confirm acceptance in writing and you provide the required shipping instructions and documents.
• You warrant that you are the owner of the goods or are authorised by the owner to ship them, and that all details you give us about the cargo, including weight, volume, contents, and value, are true and complete.
• We may refuse or suspend any shipment that appears unsafe, unlawful, improperly declared, or likely to damage other cargo or equipment.

5. Your Cargo and Your Obligations

You agree to:

• Pack and label cargo properly for the mode of transport, including any required markings and handling labels.
• Declare goods accurately, including honest values for customs. Undeclared or under-declared cargo exposes you to KRA re-valuation, penalties, and seizure, and we will not participate in it.
• Provide documents on time, including commercial invoices, packing lists, and any required certificates such as PVoC, MSDS for dangerous or sensitive goods, or import permits.
• Meet your payment obligations as invoiced, so your cargo can be released and delivered without delay.

Dangerous goods, sensitive goods, perishables, and high-value cargo require prior written acceptance from us before booking.

6. Customs, Duties, and Taxes

Unless otherwise agreed in writing, we act as your clearing agent and you remain the importer of record. You are responsible for all duties, taxes, and statutory charges, including import duty, VAT, IDF, and railway development levy where applicable. We will always tell you what we know about these charges in advance and show them clearly on quotations and invoices.

You authorise us to sign and submit declarations and documents on your behalf as your agent, as needed to clear your cargo.

7. Transit Times and Delays

Transit times we publish, such as 30 to 40 days for sea freight from China or about 7 days for UK air cargo, are good-faith estimates based on typical carrier performance. They are not guaranteed delivery dates. Carriers can and do alter schedules, omit ports, or face congestion, weather, and security delays.

We will keep you informed of your shipment's status and expected arrival. We are not liable for delays caused by carriers, customs, inspections, force majeure events, or your own documentation delays, but we will always work to minimise them.

8. Payment Terms

• Freight and service charges are due as stated on your invoice, commonly before release or delivery of cargo.
• We may require a deposit before booking, especially for first-time customers or new routes.
• Unpaid invoices may result in cargo being held at origin or destination pending settlement, and storage charges accruing. We will always notify you before any such step.
• All prices are exclusive of bank charges, and any taxes apply in addition unless stated.

9. Liability and Insurance

Our liability for loss of or damage to cargo is limited in accordance with the applicable international convention and Kenyan law, including the Carriage of Goods by Sea Act and, for air, the Convention for the Unification of Certain Rules for International Carriage by Air. In any event, our liability is limited to the lower of the declared value of the goods or the applicable convention limits, per kilogram.

Claims must be notified in writing at the time of collection or delivery, with a detailed claim following within 14 days.

We can arrange all-risks marine or air cargo insurance on your instruction at competitive premiums. If you decline insurance, cargo travels at your risk within the limits above. We strongly recommend insuring all shipments.

10. Force Majeure

We are not liable for failure or delay in performing our obligations where caused by events beyond our reasonable control, including acts of God, war, terrorism, strikes, port congestion, customs actions, epidemics, government restrictions, or failures of carriers or utilities. We will notify you promptly and resume performance as soon as reasonably possible.

11. Termination and Suspension

You may end an instruction at any time before cargo is booked, bearing any costs already incurred. We may suspend services if you fail to pay, provide false information, or breach these terms, after giving notice and a reasonable chance to remedy. Provisions that should survive termination, including liability, payment, and governing law, do survive.

12. Governing Law and Disputes

These terms are governed by the laws of Kenya. The courts of Kenya have exclusive jurisdiction over any dispute arising from them. We will always try to resolve disagreements commercially and quickly first; please raise issues with your account contact or email inquiry@heightscargo.com.

13. Changes to These Terms

We may update these terms from time to time. The current version is always published on this page with its last update, September 2026. Continued use of the site or our services after changes take effect constitutes acceptance.
